    The Debt Recovery Tribunals have been established by the Government of India under an Act of Parliament (Act 51 of 1993) for expeditious adjudication and recovery of debts due to banks and financial institutions and they are auctioning some properties. According to latest data from the Reserve Bank of India, the gross non-performing assets of state-run banks touched 68,597 crore at the end of December 2010, an increase of 27% from a year ago.

    Sweepstakes scams continue to rack up victims, despite warnings to the public. Often, senior citizens are the target of these types of scams. Thus, sweepstakes scams are a form of financial elder abuse. In a typical sweepstakes scam, a fraudster contacts an elderly victim and informs them that they have won lottery. The catch is that the elderly victim is then told that they must send in money in order to collect the sweepstakes prize. California financial elder abuse attorneys warn senior citizens not to fall victim to sweepstakes scams.

    Recently, the Federal Trade Commission announced that it is putting an end to one large sweepstakes scam based in Ventura County. The defendant in the case owned three companies that allegedly mailed out more than 3.7 million letters to people in more than 156 countries. In this case, instead of asking for large sums of money from senior citizen victims, they asked for smaller sums of money. California financial elder abuse attorneys warn the public not to fall for sweepstakes scams no matter how much money the fraudsters ask for.

    In this case, the senior citizen victims received personalized letters with official looking seals, stamps and bar codes. The seniors were told that they had won millions of dollars and could get the money by first sending in a small fee of $20-$30 within a limited period of time. According to the Federal Trade Commission, the scam has brought in more than $11 million dollars, mostly from senior citizens. California financial elder abuse attorneys say that senior citizens are often targeted for these kinds of mailings.

    One of the letters that was mailed out as a part of this scam states that the victim has been chosen from a pool of 250,637 names. There is fine print on the back of the letter that states that consumers will actually only receive lists of sweepstakes they can enter instead of a cash prize. According to the Federal Trade Commission, the fine print does not clear the company of wrong doing because the claims are misleading and victims do not get what they are promised. Frequently, people do not see the fine print and send in the $20-$30 fee.

    Sweepstakes scams such as this are widespread and one of the top five scams targeting consumers, according to the Federal Trade Commission. The fact that sweepstakes scams successfully target senior citizens makes them another form of financial elder abuse.

    Unit trusts and Open Ended Investment Companies (OEICs) are types of collective investments. In a collective investment, each individual investment is pooled with every other individual investment and then invested as a whole by the manager of the investment.

    Different unit trust and OEIC funds invest in different asset classes – shares, bonds, cash and property. Some funds focus on just one asset class, while others invest in two or more. Irrespective of the asset class or classes they invest in, most fund managers will hold a wide spread of investments in their chosen asset class. That is one of the reasons why unit trusts and OEICs are popular with investors spreading investments across a range of businesses can help reduce a funds volatility and the risks for its investors.

    Although unit trusts and OEICs are both open-ended investments, where the size of the fund varies according to market supply and demand, there are a number of key differences between the two types of funds.

    Investors in unit trusts buy and sell a portion of the total fund in the form of units. The price unit holders initially pay for units (the bid price) is higher than the price they can sell the units for (the offer price): the difference between the two prices is known as the spread. In order for unit holders to make a return on their investment, the closing bid price must always be higher than the opening offer price. An OEIC fund on the other hand, does not trade in units but issues shares to its investors and is therefore an investment company – a less complex entity than a unit trust. Shares in an OEIC have a single price, which is determined by the value of the fund’s underlying investments. All shares in an OEIC are bought and sold at one single price, so theres no bid/offer spread to take into account.

    The value of an investment in a unit trust or OEIC will vary according to the total value of the fund, which is determined by the performance of the investments the fund manager makes.     One of the kinds of scams that the government is quick to crack down on is foreclosure consultants offering false loan modification services to homeowners facing the loss of their homes . While the government is providing its own modification programs, it is also going after a number of fraudulent schemes that have been used to trick borrowers .

    There are a large number of scams that target foreclosure victims, but the loan modification one may be the easiest for the criminals to engage in. The general way it works is that borrowers pay hundreds or thousands of dollars for the services of a loss mitigation company. After signing the agreement and taking the payment, however, the company provides almost no services, resulting in the borrowers losing the property.

    Many mortgage modification scams are almost entirely made up of borrowers paying money to a company which then sits on the cash, performs almost no services, and simply disappears or denies giving a refund after thehomes is auctioned. There are hundreds of complaints about such companies, and it seems as if the attorney general of one state or another shuts down a new one every week.

    However, there are some differences on the theme, as well. For instance, some loss mitigation companies will take borrowers money and obtain an unaffordable modification program, even if there is a chance to negotiate with the financial institution for a more beneficial arrangement. The company obtains the first, easiest modification possible, presents it to the borrowers, and declares its work done. Unfortunately, though, an unaffordable plan will not help borrowers remain in their houses.

    Another variation on the scheme is simply to charge borrowers to attend loan modification seminars. This may be as part of a larger program to help them negotiate for better loan terms, although the seminars can cost upwards of several thousand dollars. If the borrowers do not attend the seminar, they will not receive help from the foreclosure scam company, which will blame the failure on the borrowers.

    A final scam related to loan modifications that is being heard of more often is companies charging for loan audits that are performed by someone other than an attorney. Information provided in these audits is also often unnecessary, as the claims that the borrowers are encouraged to raise are barred by the expiration of the statute of limitations for that particular argument. For thousands of dollars, borrowers are told what will not work in defending their homes.

    Unfortunately, many borrowers are taken in by these and similar scams every day. States are most often behind in prosecuting and shutting down these companies because there are simply so many of them, and the dollar amounts they steal from borrowers are relatively small. Thus, it is up to the borrowers themselves to make sure they are dealing with a trustworthy company or individual who is offering them foreclosure help or negotiation services in the pursuit of a loan modification or other workout option.
